1. Who is responsible for your information?

BlackHer Enterprise (Pty) Ltd, trading as BlackHer Consultancy, is the responsible party for personal information collected through this website and in connection with its consultancy services. The company is based in Durban, KwaZulu-Natal, South Africa.

2. Information we collect

Depending on how you interact with us, we may collect:

• your name, email address, mobile number, location and institutional affiliation;
• information included in a quote request or enquiry, such as your discipline, project type, research stage, support required, consultation preference, deadline and research question;
• limited information about a proposed dataset, including its format, approximate size and software requirements;
• mailing-list subscription details and consent preferences;
• correspondence, meeting arrangements, quotations, contracts and payment-related records; and
• limited technical information generated when the website is used, where necessary for hosting, security and reliable operation.

The public website does not request dataset uploads. Please do not submit confidential datasets, health information, identification numbers, participant-level records, passwords or other sensitive research material through an enquiry form or ordinary email.

3. Why we process personal information

We process personal information only for a specific and lawful purpose, including to:

• respond to enquiries and assess whether we can assist;
• prepare quotations, define project scope and arrange consultations;
• deliver agreed consultancy, training and research-support services;
• maintain client, contractual, accounting and compliance records;
• send requested mailing-list communications and manage unsubscribe requests;
• protect the website, prevent spam and maintain service reliability; and
• comply with applicable legal, regulatory and professional obligations.

The justification for processing may include your consent, steps taken at your request before entering into a contract, performance of an agreement, compliance with a legal obligation, or a legitimate business interest that does not unjustifiably interfere with your privacy.

4. Research and client information

Enquiry details, client information, unpublished findings and research materials are treated as confidential and used only for the agreed purpose. If an engagement will involve personal, special personal, institutional or otherwise sensitive information, the parties must first agree an appropriate contract, confidentiality arrangement and secure transfer method.

BlackHer Consultancy does not use client research materials to train public artificial-intelligence models, publish findings or reuse information for an unrelated purpose without written authorisation.

5. Mailing list and direct marketing

Mailing-list details are collected only after an affirmative opt-in and are kept separately from consultancy enquiries. You may withdraw consent or unsubscribe at any time by using an unsubscribe facility in a message or emailing info@blackherconsultancy.co.za. Withdrawing consent does not affect processing that was lawful before the withdrawal.

6. Who may receive your information?

We do not sell personal information. Access is limited to BlackHer Consultancy and service providers that support website hosting, database storage, email delivery, communications, administration or professional compliance. These providers may process information only to provide the relevant service and are expected to apply appropriate confidentiality and security safeguards.

Information may also be disclosed where required by law, to protect legal rights, or with your instruction or consent.

7. Processing outside South Africa

Some website, hosting or email-delivery providers may process information outside South Africa. Where personal information is transferred internationally, BlackHer Consultancy will take reasonable steps to ensure that the transfer is permitted under section 72 of the Protection of Personal Information Act 4 of 2013 and that appropriate safeguards apply.

8. Retention

Personal information is retained only for as long as reasonably necessary for the purpose for which it was collected, to manage an enquiry or engagement, establish or defend legal rights, and meet applicable contractual, tax, accounting or regulatory requirements. Mailing-list details are retained until you unsubscribe or the list is discontinued. Information that is no longer required will be deleted, destroyed or de-identified where reasonably practicable.

9. Security

BlackHer Consultancy applies reasonable technical and organisational safeguards appropriate to the nature of the information, including access controls, secure hosting and restricted handling of client materials. No internet transmission or electronic storage method is completely risk-free. If a security compromise affects personal information, BlackHer Enterprise (Pty) Ltd will take the steps required by applicable law.

10. Your rights

Subject to POPIA and other applicable law, you may:

• ask whether we hold personal information about you and request access to it;
• request correction, updating or deletion of inaccurate or unlawfully held information;
• object to certain processing or withdraw consent where processing is based on consent;
• request evidence of the consent you previously provided; and
• lodge a complaint with the Information Regulator of South Africa.

11. Website storage and cookies

The website may use essential browser storage and service-worker technology to remember functional preferences, support currency display and enable app-like access. The current website does not use advertising cookies or behavioural profiling. If non-essential analytics or marketing technologies are introduced, this notice and any required consent controls will be updated.
